These Terms and Conditions ("Terms") govern the relationship between Blendko (“we”, “our”, “us”) and you (“you”, “the customer”, “the user”) in connection with all services, products, and platforms we offer. If you do not agree with any part of these Terms, please discontinue use of our services.

2. Acceptance of Terms

By using any part of our services, including browsing our website, creating an account, placing an order that you confirm that:

• You are at least 16 years of age

• You have the legal capacity to enter into a binding agreement

• You agree to comply with these Terms and all applicable laws

We reserve the right to update these Terms at any time. Continued use of our services following an update constitutes your acceptance of the revised Terms. We will notify users of significant changes via email or a notice on our website.

3. Account Registration

To access certain features of our platform, including the AI customisation tool and order tracking, you may need to create an account. When registering, you agree to:

• Provide accurate, current, and complete information

• Keep your login credentials confidential and secure

• Notify us immediately of any unauthorised use of your account

• Accept responsibility for all activity that occurs under your account

Blendko reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, harmful, or disruptive behaviour.

5. Products & Orders

5.1 Product Descriptions

We endeavour to present all products accurately, including descriptions, imagery, and pricing. However, we do not warrant that all product descriptions or other content on our platform are entirely free from error. If a product you receive differs materially from its description, you may be entitled to a return under Section 9.

5.2 Placing an Order

When you place an order with Blendko, you are making an offer to purchase goods subject to these Terms. An order is only confirmed when you receive an email order confirmation from us. We reserve the right to decline or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or stock unavailability.

6. Pricing & Payment

All prices are displayed in GBP (£) and are inclusive of applicable VAT unless stated otherwise. Prices are subject to change without notice, but changes will not affect orders already confirmed.

We accept payment via major credit/debit cards, PayPal, and other methods displayed at checkout. All payments are processed securely through our third-party payment providers. Blendko does not store full card details.

In the event of a pricing error, we reserve the right to cancel the order and issue a full refund. We will notify you promptly if this occurs.

7. Shipping & Delivery

We aim to despatch standard orders within 3–5 business days and custom orders within 10–14 business days, depending on production complexity. Delivery timeframes are estimates and not guaranteed.

Blendko is not responsible for delays caused by third-party logistics providers, customs processes, or circumstances outside our control. Risk of loss or damage passes to you upon delivery.

For international orders, you are responsible for any import duties, taxes, or customs fees applicable in your country.

8. Intellectual Property

8.1 Blendko’s Intellectual Property

All content on our website and platform — including but not limited to logos, brand name, designs, images, copy, the Blendko AI tool, and collections — are the exclusive intellectual property of Blendko or its licensors and are protected by copyright, trademark, and design laws.

You may not reproduce, distribute, modify, publicly display, or use any of our intellectual property without our prior written consent.

8.2 Your Custom Designs

When you create a design using our platform, you retain a personal licence to purchase and wear the resulting piece. However, the underlying design infrastructure, AI model, and any patterns, motifs, or templates provided by Blendko remain our property. You may not commercialise, resell, or reproduce designs created through our platform without written permission.

9. Returns, Exchanges & Refunds

9.1 Standard Items

You may return standard (non-customised) items within 14 days of delivery for a full refund or exchange, provided they are:

• Unworn, unwashed, and in original condition with all tags attached

• Returned in their original or suitable packaging

• Accompanied by proof of purchase

Return shipping costs are the responsibility of the customer unless the item is faulty or incorrectly sent.

9.2 Custom & Personalised Items

As noted in Section 5.3, custom and personalised orders are non-refundable and non-exchangeable except in cases of:

• A manufacturing fault or defect

• The product being materially different from the agreed design

• Damage incurred during delivery

9.3 Faulty Items

If you receive a faulty item, please contact us at returns@Blendko.com within 7 days of receipt with photographs and a description of the fault. We will arrange a replacement, repair, or refund at our discretion.

10. Sustainability & Ethical Practices

Blendko is committed to responsible fashion. By purchasing from us, you support a brand that:

• Partners with skilled artisan communities across Africa, ensuring fair wages and safe working conditions

• Employs sustainable packaging and shipping practices

• Designs for longevity — not fast fashion

We do not tolerate exploitation of workers or the environment at any stage of our supply chain.

11. User Conduct

When using our website or platform, you agree not to:

• Use our services for any unlawful, fraudulent, or harmful purpose

• Upload or submit content that is offensive, defamatory, or infringes third-party rights

• Attempt to gain unauthorised access to our systems or data

• Use our AI customisation tool to generate designs that appropriate or demean cultural heritage

• Engage in any activity that disrupts or damages the performance of our platform

Blendko reserves the right to restrict or terminate access for any user who violates these standards.

12. Cultural Sensitivity & Brand Values

Blendko exists to close the gap in diversity by creating a space where Western style and African heritage come together authentically. We celebrate cultural pride, not cultural appropriation.

When using our platform, you agree to engage with our brand and its cultural elements respectfully. Designs or uses of our platform that misrepresent, mock, or trivialise African or any other cultural heritage are strictly prohibited and may result in order cancellation and account suspension.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Blendko shall not be liable for:

• Any indirect, incidental, special, or consequential loss arising from your use of our services

• Loss of profits, revenue, data, or goodwill

• Losses resulting from events outside our reasonable control (force majeure), including natural disasters, pandemics, or supply chain disruptions

Our total liability to you for any claim arising from our services shall not exceed the amount you paid for the specific order giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any matter that cannot be excluded by law.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Third-Party Links & Services

Our website may contain links to third-party websites or integrate third-party services (such as payment processors or social media platforms). Blendko is not responsible for the content, privacy practices, or terms of those third parties. Accessing external links is done at your own risk.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
